In recent years ATV riding has become more popular, appealing to new enthusiasts as well as those who use ATVs for work or recreational purposes. Unfortunately, as the popularity of ATV riding has increased, so has the number of serious ATV accidents.
According to the Consumer Product Safety Commission, there were an estimated 882 ATV related deaths in 2006. During that same year, there were 146,600 ATV related injuries treated in emergency rooms across the country. Sadly, many of those injured were children 16 years of age or younger. Although some of the injuries and deaths can be attributed to operator error, many are the result of design defects or mechanical problems.
The U.S. Consumer Product Safety Commission (CPSC) is charged with protecting the public from unreasonable risks of serious injury or death from consumer products. In recent years CPSC has recalled numerous ATVs due to the dangers posed by improper design or manufacturing problems.
Yamaha Rhino Accidents
The Yamaha Rhino Recreational Utility Vehicle has been at the center of controversy for several years. The Yamaha Rhino is a four-wheel, side by side, all terrain vehicle in which the driver and the passenger sit next to each other. Although it was originally touted as safer than traditional ATVs, this claim has proven to be far from the truth. Hundreds of riders have been seriously injured or have died while riding the Yamaha Rhino. Many of the deaths and injuries involve children who have been thrown out of the Rhino ATV.
Yamaha Rhino Accident Lawsuits
Current lawsuits against Yamaha Motor Corporation include claims that the Rhino has multiple design flaws which make it unstable and prone to tip or rollover. Some of the defects include a top-heavy design resulting in a high center of gravity, and tires that are extremely narrow. In 2007, Yamaha announced that it would make modifications to the Rhino in an effort to make the vehicle safer. However, these changes have come too late for many who have suffered serious injury or death because of the defective design of the Rhino ATV.
